We entered into the HAMP program in February 2010 because we had fallen behind in our property taxes from 2009 and WFHM paid the taxes and created a TAX ESCROW account that almost doubled our monthly payment. We called the bank and explained our hardship and were given a 3 month trial. Although we made every payment required, WFHM continued to charge arrearages while calculating additional tax reserves. In April they asked for all new financial documentation. In May my husband suffered an aneurism, was hospitalized and became disabled. Because of his injury, we were not able to provide the documentation in their timeframe. They refused our modification in June and we were 8,000. in arrears. Because of my husband's injury, I closed my small business office.
WFHM accepted our payments but reported us to the credit bureaus as being "in default" starting in June while adding more arrearages and reserves into a tax escrow account that again raised our monthly payment. We tried to negotiate with them and continued making regular payments. After hours on the phone with the loss mitigation department, we reapplied for modification, they refused us again. They decided to accept our payments but not apply them to our loan while they continued to accrue arrearages, fines and charges and reporting us IN DEFAULT with the credit bureaus.
I've written letters to object, they have no response to our inquiries or questions. I engaged a third part to negotiate with them. They tell me the payments are in a FROZEN account. The tactics used with our payments NOT being applied and then placing credit reports of NO payment since JUNE 2010 has further damaged our ability to get another loan. This makes it impossible to find another lender to replace WFHM should we fail to negotiate a deal. WFHM is thereby holding us and our HOME hostage in spite of our efforts, to correct the problems we are having with them. Meanwhile the monthly payment has been raised again to accommodate the taxes.
We have NO explanation regarding the rules of the ESCROW account that was imposed on us. They have now added charges for home owners insurance even though we never missed a payment on our existing policy. The arrearages are currently at 13,000. even though we have made a payment every month. They have said that we can't QUALIFY for a modification because they can't count my husband's disability payments as income. With my business losses this year, they decided we don't have enough income to keep our home. At the worst possible time, with our credit in the ditch, we are expected to QUALIFY for their home loan application. We have made regular payments on this house for 20 years, now we are expected to reapply to them in order to keep our home?
Wells Fargo has received millions to help homeowners that are in trouble but instead of helping, they have used this as an opportunity to clean their inventory of troubled homeowners. They want every troubled homeowner to reapply for a loan that they can't possibly QUALIFY for, without any concern for the hardship they are currently facing. The trial process takes so long and arrearages grow so high that the homeowner has little chance to recover when they are refused a modified loan.
WFHM has ignored my "qualified written request", our appeal of property taxes and their escrow accounting. I have made formal complaints to the Comptroller of Treasury's office, my Congressman, The Attorney General, FreddieMac, FHA, The Congressional Oversight Committee and HUD. I'm getting very little help fighting to save our home of 20 years, everything we've worked for our entire lives, and the homestead of our family. I'm not superwoman.... I'm just a person, a mother and wife who is trying to manage financial recovery from my business losses and my husband's disability. Although we are in great need of immediate consideration, I'm left to negotiate a new loan with this intransigent lender who turns a deaf ear to any realistic consideration while adding up arrearages and preparing to foreclose. Where's the help we've been promised?
