I had a loan with Indy Mac bank which was later transfered to Onw West Bank. I started my trial modification with Indy Mac bank in January, 2010 and successfully completed the trial modification. Meanwhile, Bank kept asking me for the pay stubs, which I submitted several times. All this time I was paying my mothly modified amount on time, till I got a foreclosure notice from the Sharrif in October, 2010. When I called the bank about the forclosure notice they told me that Bank sent me a letter on 30th of August denying my modification request. I never received that letter becuase I would have filed an appeal for denial within 30 days.

When I read the mortgage foreclosure complaint I saw the verification signed by Erica A. Johnson Seck as vice President of one west bank fsb. I had read so much about her role as a ROBO SIGNER that I immediately started to do the research and called the attorneyof One West Bank to ask him questions about the verification. Although, I do not have money to fight the bank, I was advised that I must get an attorney to handle this at least at the initial stages. Anyhow, my attorney replied to the complaint. Next week One West Bank attorney called my attorney and told him that they are going to file a new complaint. 

One West Bank's attorney has filed a new complaint but the verification is done by another person. I hope someone can answer my questions.

1. In my opinion One West Bank by changing the Verification of Erica A. Johnson- Seck is admitttting that Bank filed falsified documents in its original complaint.

2. Can bank change the verification of MS. Seck after it was filed with original complaint ?

3. Is bank liable for the money I spend on answering the original complaint?

4. Can I file a complaint against the bank for filing the  falsified complaint and ask for damages.

I would very much appreciate input in this matter.
